If you work for New York City Health + Hospitals or a New York City Mayoral Agency and suffer a work-related injury or illness, you may be eligible for workers’ compensation benefits. 

Benefits provided by the New York State workers’ compensation system include:  

  • Payment for medical expenses  
  • Partial wage replacement 
  • Payment for loss and disfigurement  
  • Death benefits  
  • Rehabilitation services  

If you suffer a work-related injury or illness, take the following steps:  

  • Seek medical care promptly. If you require emergency care, you may go to any doctor or hospital for initial emergency care. Inform the doctor that the injury/illness is work related. After initial emergency treatment, you must use a NYS Workers’ Compensation Board (WCB) certified medical provider. The medical provider must fill out and file a C-4 form with the NYS WCB. 
  • Fill out a NYS WCB Employee Claim Form (C-3) and submit it to the NYS Workers’ Compensation Board as soon as possible, but no later than 2 years after the accident. 
  • If you are a NYC Health + Hospitals employee, fill out an Employee’s Notice of Injury Form (WCD-23) and submit it to your supervisor as soon as possible, but not later than 30 days after the accident. Fill out an Employee’s Selection of Compensation Form (DP2002) and submit it to your supervisor as soon as possible, but no later than 7 calendar days after the accident. See New York City workers’ compensation forms. If you are employed by a NYC Mayoral Agency, contact your HR Department or Leaves Administrator for workers’ compensation forms.  
  • If you were injured on the job due to assault, remember to fill out your employer’s workplace violence reporting form.
  • New York State Civil Service Law Section 71 allows for up to a year's leave for a work-related injury or illness and up to 2 years’ leave if the injury was caused by assault in the line of duty.  
  • NYC public sector employees may qualify for an additional wage payment beyond what is paid by the NYS WCB. See Article V Section 7 of the Citywide Contract for further information. You may also contact your leaves administrator; NYC Health + Hospitals employees may request more information. 

Only the NYS Workers’ Compensation Board has the authority to determine if a claim is compensable. Your supervisor and the NYC Law Department Workers’ Compensation Division cannot prevent you from filing a claim and cannot determine if you have a right to workers’ compensation benefits.
